Last updated: 10 October 2026
1. Acceptance of Terms
By accessing this website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the website. Section 10 sets out the law that governs these Terms.
2. Description of Service
pvSpline is photovoltaic energy analysis software published by the company PvSpline and used in a web browser. This website presents the product, its documentation and its pricing.
3. The pvSpline Licence (EULA)
The pvSpline application and software are licensed under the pvSpline End User License Agreement (EULA), not under these Terms. You accept the EULA when you create an account or first launch the software; its current text is published at app.pvspline.fr/legal. Copies of the demo downloaded from this website before September 2026 remain governed by the EULA accepted when they were first launched.
4. Intellectual Property
pvSpline, its source code, algorithms (including spline interpolation implementations), documentation, and all associated materials are the exclusive property of the company PvSpline, protected by French intellectual property law (the French Intellectual Property Code, Code de la propriété intellectuelle), by European Union law, in particular Directive 2009/24/EC on the legal protection of computer programs, and by international treaties, including the Berne Convention.
5. Data & Privacy
Your use of pvSpline may involve processing of energy consumption data obtained from Enedis under your explicit authorisation. All data processing complies with the GDPR (Regulation (EU) 2016/679). See our Privacy Policy for details.
6. Disclaimer of Warranties
This website and its content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
The warranties that apply to the pvSpline application and software are those of the EULA (§ 8). Energy production estimates, financial projections, and savings calculations are indicative only and should not be the sole basis for investment decisions.
7. Limitation of Liability
To the maximum extent permitted by applicable law (including Council Directive 85/374/EEC on product liability), PvSpline shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the website. Liability relating to the pvSpline application and software is governed by the EULA (§ 9).
Where the applicable law does not allow the exclusion of certain warranties or the limitation of liability for indirect loss, our liability is limited to the maximum extent that law permits.
8. Prohibited Use
You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorised access to our servers or infrastructure
- Introduce malicious code or viruses, or interfere with the operation of the website
- Access, scrape or crawl the website by automated means beyond normal use
- Perform security testing without prior written authorisation from PvSpline
9. Suspension and Termination of Access
PvSpline may suspend or end your access to the website at any time and without notice for conduct that violates these Terms or is harmful to other users, to PvSpline or to third parties.
10. Governing Law & Jurisdiction
These Terms are governed by French law. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence (Article 6 of Regulation (EC) No 593/2008, “Rome I”).
Any dispute relating to these Terms or to your use of the website falls within the jurisdiction of the competent French courts, without prejudice to the mandatory rules of jurisdiction that protect consumers, including Articles 17 to 19 of Regulation (EU) No 1215/2012 (“Brussels I bis”).
